STILL NOT CLOSED. At the last minute, after we met the contractor and John Fluker at the property and scheduled starting date, we find out that there was no mention in the contract that we took over about the city lien on the house. It turns out that the city lent money to add a bedroom and laundry room. I knew it was there but realized that there was no mention of how and when and who was going to pay that off. My understanding (not in writing so worth nothing) was that we were taking the house subject to the city lien and that it would be paid by the seller when we cashed her out in 5 months.
The seller says that they have fulfilled the terms having lived in the house so long. Not good enough- got to have something in writing. I don’t care who pays as long as its not me.
We have postponed this so many times, i hope the contractor does not get disgusted and leave. I have started work before the coe many times but not with an outstanding issue to be solved.
